Terms of Service

Account Creation: To access certain features (including synchronization across devices and multi-user wallet functionalities), you must create an account by providing accurate and current information, including your email address and a password.

Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Accurate Information: You agree to provide accurate, complete, and up-to-date information when creating your account and to update your information to keep it accurate and current.

License Grant: We grant you a limited, non-exclusive, non-transferable license to access and use our Services for your personal, non-commercial use, strictly in accordance with these Terms.

Restrictions: You agree not to:

1. Modify, distribute, or create derivative works based on the App or any portion thereof.
2. Reverse engineer, decompile, or otherwise attempt to extract the source code of the App or any part of the Services.
3. Use the Services to collect or store personal data about others without their express permission.
4. Interfere with or disrupt the integrity or performance of the Services.
5. Use the Services for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation.

Free and Paid Features: The App offers both free functionalities and premium features. Certain features may require a subscription or one-time payment ("Paid Services").

Billing and Payment: If you choose to use the Paid Services, you authorize us (or our third-party payment processors) to charge the applicable fees. You are responsible for providing current, accurate, and complete billing information.

Automatic Renewal: Any subscription you purchase may automatically renew at the end of each billing cycle unless you cancel before the renewal date.
Fees for subsequent periods will be charged to your designated payment method.

Cancellation and Refunds: You may cancel your subscription at any time. Please note that cancellation requests may not result in a refund. Refund policies may vary depending on the platform’s rules (e.g., Apple App Store).

Shared Wallets: Our App allows you to create and manage shared wallets with multiple users. You are responsible for determining who has access to shared wallets and for managing permissions accordingly.

Data Ownership: All transaction data and financial details entered by users are owned by the respective account owners. You acknowledge and agree that we are not liable for any disputes arising between users concerning shared finances.

When using our Services, you agree not to:

1. Impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity.
2. Upload, post, or transmit any content that you do not have the lawful right to transmit or that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
3. Use the Services to violate any applicable laws, rules, or regulations.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these provisions, including terminating or suspending their account.

Ownership: All content, features, and functionality of the Services (including but not limited to text, graphics, logos, icons, images, and software) are owned by or licensed to us and are protected by intellectual property laws.

Trademarks: All trademarks, service marks, and trade names appearing on the Services are the property of their respective owners. Use of these marks without our written consent is prohibited.

Your use of our Services is subject to our Privacy Policy. By using our Services, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy. If you do not consent, please discontinue use of our Services.

No Warranty: The Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Accuracy of Information: We strive to ensure the accuracy of the data presented within the App (e.g., budgeting, expense tracking). However, we do not guarantee the completeness, accuracy, or reliability of any information available through the Services.

Financial Decisions: You acknowledge that all decisions made using the financial and budgeting information provided by the Services are your responsibility. We are not liable for any financial decisions you make based on the information provided.

To the fullest extent permitted by applicable law, in no event shall we or our officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with:

1. Your use of or inability to use the Services;
2. Any unauthorized access to or alteration of your data;
3. Any conduct or content of any third party using the Services; or
4. Any other matter related to the Services.

In no event shall our total liability for all claims arising out of or relating to these Terms exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim (if any).

You agree to defend, indemnify, and hold harmless Money Tracker, its affiliates, and their respective officers, directors, employees, and agents, from and against all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:

1. Your use of and access to the Services;
2. Your violation of any term in these Terms;
3. Your violation of any third-party right, including without limitation any intellectual property right or privacy right; or
4. Any claim that your use of the Services caused damage to a third party.

Termination by You: You may stop using the Services and delete your account at any time via the App’s account settings.

Termination by Us: We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, for any reason, including your violation of these Terms.

Effect of Termination: Upon termination, your right to access and use the Services will immediately cease. Any data associated with your account will be deleted or deactivated according to our Privacy Policy.

We may update these Terms from time to time in our sole discretion. If we make material changes, we will notify you via email or by posting a notice within the App. Your continued use of the Services after the posting of revised Terms means that you accept and agree to the changes.

These Terms and any dispute arising out of or related to them or the Services will be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions. Any legal action arising out of or relating to these Terms shall be filed only in the courts located in Ukraine, and you consent to the personal jurisdiction of those courts.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Money Tracker regarding your use of the Services.

Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms, or any rights granted hereunder, without our written consent. We may assign or transfer these Terms without restriction.
